The cab was then pulled over, and Officer Mejia and Officer Jagdeo threw Plaintiff to the ground on his back and beat him about the head, fact and body with close fists. At this time, a second police vehicle driven by Sergeant G. Faliean and Officer L. Prehan pulled up to the scene, who proceeded to also punch Plaintiff. Officers also used their taser guns on Plaintiff at least seven or eight times without explanation. Ultimately, Plaintiff was put into a position on his stomach, his head pressed against the concrete road, his hands behind his back and the weight of the four officers bearing down on him. Plaintiff was then taken to the precinct to be fingerprinted and photograph but then was taken to Bellevue Hospital for his injuries. A police vehicle driven by PO G. Mejia with PO B. Jagdeo pulled up and one of them ordered the associate to \"get the fuck out.\" POs Mejia and Jagdeo pulled the taxi over, removed the associate, threw him to the ground, and beat him about the head, face, and body. As the assault was occurring a second police vehicle containing Sgt. G. Faljean and PO L. Prehn pulled up and one of these officers got on top of the associate and proceeded to punch him about the face, head, upper body, wrist, and shoulder. Plaintiff was observing the assault from approximately 5 feet away and was directed to back up by a PO who displayed a taser in his hand. Plaintiff felt he was not free to leave due to this display of authority. Plaintiff backed up approximately 10 feet as he observed POs taser his associate 7 or 8 times. Plaintiff's associate was lying on his stomach as he was tasered with his head pressed against the concrete road, his hands behind his back, and the weight of 4 officers bearing down on his body. Plaintiff's associate repeatedly screamed for POs to stop and protested his innocence. When Plaintiff also protested an officer again threatened him with a taser. \n\nAt this time Plaintiff attempted to video-record the assault. In retaliation for Plaintiff's attempt to exercise his first amendment right POs conspired to falsely arrest Plaintiff. They did so and handcuffed and searched Plaintiff. The search revealed a folding knife, which was clearly not a gravity knife by simple visual inspection and physical manipulation. As Plaintiff was arrested he watched other POs continue to taser, punch, and kick his associate, and Plaintiff was in fear for his own safety as he witnessed the violence. Plaintiff was taken to the 7th Precinct then Central Booking, and was ultimately in custody for approximately 15 hours before his release. Plaintiff was compelled to return to court 6 times to defend against the false charges and incurred $2,500 in attorneys' fees before his case was ultimately dismissed on January 23, 2015.
