When arrested, officers lifted plaintiff out of his car and placed him in his wheelchair. An NYPD van arrived to transport plaintiff to the precinct, but the van was not wheelchair accessible. Officers instead lifted plaintiff into the van but did not secure him in any way. Plaintiff could not hold himself upright as his hands were handcuffed and once the van moved, he fell to the floor. He hit his head, neck and body as the van made its way to the precinct. Officers denied his request for alternative transportation. \nOnce at the precinct, the holding cells were not wide enough for his wheelchair so he was handcuffed to a bar on a wall outside of the calls for the majority of his 38 hour detention. Plaintiff could not adjust himself during this time, which is required to prevent sores, clots and infection. Plaintiff was also not given a sanitary bottle to empty his catheter into and was instead given a gatorade bottle. The bathroom the precinct did have was not physically accessible to him. Then plaintiff was punched on the side of his body by Defendant Officer Mattthew Vorraro. A third John Doe officer pushed Plaintiff into a tree before they took him to the precinct. At no point did any of the three plainclothes officers identify themselves as police officers. Plaintiff sustained a fracture to his zygomatic arch. He was falsely charged with two counts of possession of marijuana, obstruction of governmental administration and resisting arrest. Defendant Vorarro falsely alleged that he saw Plaintiff exchange a glassine bag for money and that he swung at the officer first and resisted arrest. Plaintiff McLennon was able to shoot on of the attackers, who fled and dropped a bloody knife outside.  After police arrived, they arrested the Plaintiffs for attempted murder and other crimes, and conducted an illegal search of the home.  Defendant Officer Steven Deluca organized the search and orchestrated a plan to show the shooting took place outside the home as justification for the prosecution.  This included deliberately losing exculpatory evidence and hiding facts for many years, as a result of which Plaintiff McLennon spent four years in jail awaiting trial and Plaintiff Campbell spent one year in jail.  Detective Bendig, Officcr Vorraro, Detective Alalnonte and Detective Deluca also lied to several grand juries and at trial regarding where the crime took place, what was discovered during searches, and when the illegal searches were performed.  Plaintiff McLennon was acquitted in trial on December 15, 2012.
