On October 18, 2016, she was shot and killed after the NYPD responded to a noise complaint from her neighbor. Plaintiff-Decedent was suffering from an episode related to her disability, and historically, unarmed specially trained ESU officers were sent to respond. On October 18, 2016, a 911 communications dispatcher incorrectly dispatched NYPD officers and falsely labeled Plaintiff-Decedent as violent, despite her not having any weapons. Defendant Lieutenant Ming Fang Ho failed to monitor radio transmissions per their duty to dispatch proper responders, failed to inquire about the violent label, and failed to ensure the dispatched officers complied with NYPD procedure regarding mentally ill persons. \n\nDefendants-Officers Javier Perez (Shield No. 18458), Camilo Rosario (Shield No 17378), Jabbour Rabadi (Shield No. 20356), and Michael Garces (Shield No. 9180) first responded on the scene. They forced entry into Plaintiff's apartment. Defendants Sergeant Hugh Barry (Shield No. 4738) and Officer John Martin (Shield No. 22241) arrived subsequently and were warned by the second Plaintiff (sibling to the decedent) about Plaintiff-decedent's mental health condition. Barry ignored her warning and did not check for non-lethal alternative weapons in his vehicle per procedure.\n\nWhile the other officers and EMTs were in Plaintiff's apartment and speaking calmly, Defendant Barry rushed into the apartment and charged Plaintiff-decedent, who ran into her bedroom to grab a baseball bat. He then shot and killed Plaintiff-decedent, while Plaintiff-sibling stood outside the apartment and heard the shots and then saw her sibling's body. A few minutes after midnight, June 29, 2011, numerous members of the NYPD responded to the nightclub and ordered everyone to exit the nightclub. Plaintiff Pena complied with with orders to leave and walked towards the exit. Officers McDougall and Chau grabbed Pena from behind, and punched and kicked, and struck Pena with a baton all over his body. Pena was then thrown to the ground and sprayed in the eyes with mace. Pena was arrested and placed in tight handcuffs. \nPlaintiff Diaz complied with orders and exited the nightclub. While walked away from the nightclub, Officer Diaz pushed Plaintiff Diaz and then Officer Szeto grabbed and shoved Diaz. Diaz was struck with a baton and punched and kicked by the officers.\nPlaintiff Ayala was outside the club and complied with orders. She tried to film the melee outside the club. Ayala was approached by officers and struck in the head and face, causing her to drop her camera.  \nPena and Diaz required medical attention at Bellevue Hospital.
