At the time, three of Mr. Guerrero's friends were seated inside of the vehicle. Defendant Officer Lauren Stanton and other officers approached the vehicle. An Officer directed the backseat passenger to \"put down\" a bag that the passenger had been holding before directing the three individuals to exit the vehicle. Thereafter, without Mr. Guerrero's consent, the Officers searched the vehicle. The police allegedly recovered a gun from the bag the backseat passenger had been holding. Subsequently, that passenger had admitted the gun was his and that nobody knew he was in possession of it. Although the Officers never observed Mr. Guerrero in the vehicle at any time, they handcuffed him and drove him to a precinct. Mr. Guerrero was then searched and forced to remain inside of a holding cell at the precinct. Approximately twelve hours after the initial encounter at 1:00 a.m., Mr. Guerrero was taken to Bronx County Central Booking and remained there for another twelve hours. Ultimately he was released from custody without appearing before a judge and without being prosecuted for any crime.
