Those officers had even visited Plaintiff’s apartment to force him to move out in part because Plaintiff relied on Section 8 vouchers.  \nAlthough the Officers knew Plaintiff lived in another building in the complex they asked Plaintiff if he was a resident.  Plaintiff stated he had a legitimate purpose for visiting his grandmother and had been buzzed into the building by her.  Despite this legitimate reason, the Officers searched Plaintiff, placed him under arrest for trespassing, and transported him to a precinct.  The Officer made false statements about whether he was an invited guest based on the tenant list and an affidavit from the building manager, but no tenant list was ever provided to the District Attorney or attached to the affidavit.  Defendant Lomangino signed a false criminal complaint that was the basis for an arrest. Santiago's partner was Landro Perez.Kieron Ramdeen, 46th Precinct. The judge finds he testified inaccurately regarding which officers he was working with on the night of the challenged arrest. He said he was not working with a ìHispanic officerî that night, after the plaintiff described one of the three officers who arrested him as Hispanic. Ramdeen's partner, PO Michael Pomerantz's memo book indicates that they were on patrol with a third officer, Premativo Montanez.  Judge Scheindlin finds Ramdeen's testimony that the plaintiff was arrested inside the building lobby incredible.
