Defendants then took Plaintiff in restraints to the 47th Precinct, where they questioned and charged her with criminal possession of a weapon and other related charges despite knowing Plaintiff never did such. \n\nDefendants then detained and confined Plaintiff, and took her property without her consent, causing her fright, shock, emotional distress, and physical consequences. Following Plaintiff's arrest, the Defendants transported Plaintiff in restraints to the Bronx County Central Booking. Defendants falsely asserted that Plaintiff possessed an unlawful weapon and committed other criminal offenses, fabricated evidence likely to incriminate Plaintiff, and knowingly and maliciously provided false information to the Prosecutor to charge Plaintiff with a crime despite knowing Plaintiff did not commit such. All charges brought against Plaintiff were dismissed on August 11th, 2023, in Plaintiff’s favor. One of the Defendants—Detective Charles Grove—has a pattern of arresting innocent persons per several prior lawsuits and allegations made against them. Defendant officers  gave false and misleading information to the DA's office stating that Plaintiff sold beer to a person under the age of twenty-one without asking them to verify their age or for identification. They also falsely stated that Plaintiff had open bottles of Hennessy, vodka, and empty cups without a liquor license and that she had in her custody twenty Ziplock bags of marijuana.\n\nAs a result of this unlawful arrest, Plaintiff spent approximately three days in police custody and made multiple court appearances before all charges would adjourned in contemplation of dismissal on September 29, 2014. Plaintiff, four months pregnant, suffered significant stress and depression while in custody, causing her to experience excruciating back pain and cramps and lose approximately six pounds, putting her unborn child at risk. Following her release, Plaintiff went directly to the hospital for treatment.
