At the time of the arrest, the plaintiff was in the process of putting his 20-month-old son's car seat in the back of his car and intended on getting in his vehicle to drive to meet his family for a meal.  Defendant police officer Walker accused the plaintiff of possessing a stolen car and arrested him.  Plaintiff was handcuffed and taken to the 67th precinct where he was questioned about whether he used the nickname \"Reckless\", and he was shown a photo of a man with a gun, and asked if he knew the man.  Plaintiff responded that he did not know who the person was, nor did he go by the nickname \"Reckless\".  After approximately 34 hours in custody, the plaintiff was released without seeing a judge and without being formally charged by the DA's office with an offense.  During his arrest, the plaintiff's New Jersey driver's license had been taken from him and not returned.  After his release, on October 10, 2017 at 11:00 PM, the plaintiff was driving his car to his father's house when he was pulled over by defendant police officer Contreras near Flatbush Avenue and Broadway Junction.  Defendant police officer Contreras asked for the plaintiff's license and registration, but did not listen to the plaintiff's explanation that the license was in possession of the NYPD, who had arrested him the day before.  Defendant police officer Contreras gave plaintiff a summons for unlicensed operation of a motor vehicle. Trevor Perez was present at the shooting and was unlawfully handcuffed and imprisoned shortly thereafter despite not being involved in the shooting. NYPD Detective Freed and an unidentified NYPD Officer coerced a confession from Perez by forcing him to sign a dictated statement on a photograph of Plaintiff identifying Plaintiff as the gunman. Detective Freed then colluded with Officer Seminara to have Seminara identify Plaintiff as the gunman given the illegality involved in procuring Perez's confession. Plaintiff voluntarily went to the 67th precinct where he was falsely imprisoned and interrogated by Detective Freed. Despite ample evidence that Plaintiff was not present at the location of the shooting, Detective Freed orchestrated a sham lineup and conspired with Officers Ortlieb, Henderson, and Seminara to have them maliciously identify Plaintiff as the gunman. The defendants then maliciously initiated a prosecution based on false statements and manufactured evidence. Plaintiff told him he had no drugs but Sergeant Casey said \"then why were you running?\" Thereafter, the officers arrested plaintiff and, in an attempt to cover up their unlawful assault of plaintiff, they issued a bogus summons charging him with resisting arrest and criminal possession of marijuana. Barrett, Hayes and Walker are Caucasian. Plaintiff is African-American. Plaintiff was extremely frightened. She even called the Police Department's Internal Affairs Bureau, and spoke with a detective who advised her to open the door. When Mrs. Gordon opened the door, Barrett, Hayes, and Walker barged into her apartment with guns drawn and began looking through her apartment. Having found no one else in the apartment, Barrett then told plaintiff that \"I'm going to make you suffer\" for not opening the door right away, or words to that effect Barrett then carried out that threat by arresting plaintiff without probable cause or any justification whatsoever, forcing her to get dressed and transporting her to the 67th Precinct. Barrett even admitted to plaintiff that his real reason for being at her residence was to arrest one of her sons, who allegedly had been involved in a physical altercation with two agents or employees of her landlord on an earlier date, over the landlord's removal of certain electrical appliances from the roof of the building. The unknown person robbed his friend and discharged a firearm at Plaintiff, hitting him in the left elbow. Plaintiff called 911 for an ambulance. Police officers arrived on the scene, without probable cause or reasonable suspicion, they searched Plaintiff. Plaintiff was taken to Kings County Hospital. Plaintiff's parents were at the hospital. Staff informed Plaintiff and his parents that he would be admitted to the hospital for recuperation and for surgery. His elbow was put in a splint. After Plaintiff's parents left, plaintiff was arrested by police officers, handcuffed, and led out of the hospital wearing only his hospital gown which was open in the back. Plaintiff was taken to the 67th Precinct where police officers denied him further needed medical attention for his serious injury. Plaintiff was falsely charged and prosecuted for possession of a weapon. Plaintiff was remanded to Rikers Island. Medical staff on Rikers Island removed the splint from plaintiff's elbow, despite explicit instructions that it must not be removed. Defendants deliberate indifference caused plaintiff serious and permanent injury. Based on the defendant police officers' false assertions, plaintiff continued to be prosecuted.
