Plaintiff observed their hands on their guns holsters and Plaintiff asked the officers, “what did I do?” Officers ordered Plaintiff out of the vehicle. Officers opened the passenger door and pulled plaintiff out of the vehicle, after having instructed the driver to unlock the door. An officer searched plaintiff as Plaintiff was turned around and made to put his hands on the vehicle. Officers found no weapons nor drugs on Plaintiff’s possession. Officers searched the backseat of the vehicle. Officers began guessing what gang plaintiff was affiliated with. Plaintiff denied being a member of a gang. Plaintiff was placed in the back of an un-marked police vehicle. Plaintiff was transported to the precinct, during which plaintiff complained of tight handcuffed twice, to no avail. Plaintiff while still intoxicated was tricked into writing a statement after being told by an officer that a gun was found in the vehicle. Plaintiff was released on $5,000 bail, charged with criminal possession of a weapon and possession of a controlled substance. Plaintiff returned to court once a month for the next three years. The Defendants chased the Plaintiff and threw, shoved, and slammed him onto the entryway of a building. They punched the Plaintiff in his face, head, neck, and chest. The Defendants slammed the Plaintiff onto the ground and handcuffed him. After handcuffing the Plaintiff, the Defendants continued to beat the Plaintiff, including by punching, kicking, and holding him face down on the sidewalk with the weight of one of the officer's foot/boot on his back. The handcuffs were locked too tightly and the Plaintiff's hands swelled and went numb and his shoulders began tingling. The Defendants ignored his pleas to loosen the handcuffs. The Defendants denied the Plaintiff medical attention, did not read him his Miranda rights, and did not give him a phone call. For several hours, the Plaintiff was denied medical attention until he was transported to the hospital and subjected to psychiatric evaluation in the \"psych ward,\" confined for hours. The Plaintiff was then taken to Central Booking to be processed. At arraignment, he was given the retaliatory charge of resisting arrest. After the charges were dismissed on September 7, 2018, he remained imprisoned and spent additional days in state custody. On September 12, 2018, he was transferred to the custody of the US Marshal Service. Mr. Thomas exited the cab and was pursued on foot by Officer Ingenito and in a vehicle by Officer Smith. The officers allegedly threatened to shoot him, slammed him to the ground, and subjected him to excessive physical force, including punching and kicking him, while making taunting remarks. Mr. Thomas was placed in a police vehicle, which was driven recklessly, causing him to be ejected from the vehicle. Afterward, the officers allegedly continued to assault him. Mr. Thomas sustained multiple injuries, including a broken wrist and bruises, and was falsely charged with criminal offenses. He was detained and later transported to Rikers Island.
