At the time the vehicle was stopped, Plaintiff Tiburcio\nwas on his way home with his friends, Gemini Esparra and Jermaine Rivera. Mr. Rivera was the driver and owner of the vehicle and was arrested at the scene. Defendant Police Officers released Mr. Tiburcio. Shortly after Plaintiff Rivera’s arrest, Plaintiff Tiburcio went to the precinct to check on Plaintiff Rivera and to retrieve his belonging from the vehicle. He waited a few hours and was arrested in the precinct at 6 a.m. Defendant Police Officers claimed there was a gun in the car and charged Plaintiff Tiburcio with its possession. Plaintiff Tiburcio was not in actual or constructive possession of any weapon. Moreover, the “weapon” in question was an inoperable prop gun. Plaintiff Tiburcio was released on his own recognizance at arraignment.
