Defendant Sergeant Jose Perez falsely stated that he observed Plaintiff repeatedly reach towards the bulge in his waistband and that Plaintiff refused his orders to stop, and that Plaintiff refused to put his hands behind his back, refused to be handcuffed, and refused to stop reaching for the bulge.
