[On September 21, 2009, plaintiff Gary Gill had been in Philadelphia, Pennsylvania when he was falsely arrested for the alleged murder of Simon Merriman that occurred on or about December 20, 2008.  Gill was then brought to the local (Philadelphia) precinct and falsely detained for approximately one month.]  After spending about 4 hours in the 105th Precinct, Gill was transferred to Central Booking, criminally processed and placed a dirty, overcrowded and infested cell for approximately 16 hours before being taken in front of a judge and arraigned on October 23.  Gill then spent 4 days at the Vernon C. Bain Correctional Center before being transferred to Rikers.\n\nDuring Gill’s incarceration at Rikers, he was denied his right to appear for a Grand Jury and denied the right to present witnesses on his behalf.  Gills trial would be adjourned numerous (40+) times (produced to a Court almost every time), yet Gill was brought before a judge no more than three times.  Unnecessary and continuous delays in the criminal prosecution caused Gill to await trial at Rikers for more than 5 years which, as a result, impaired the ability of Gill to adequately prepare his case.  Defendants District Attorney Peter Lomp and detectives Christopher Drew and Carl Shepard lacked probable cause, reasonable suspicion or proper claims against Gill yet continued to maliciously proceed against Gill.  The defendants engaged in an unlawful, unreasonable and arbitrary investigation leading to Gill’s arrest.  The delay in Gill’s trial was intentional, for the purpose of the release of a prisoner – the only witness and a party to a cooperation agreement – who would provide self-contradictory and uncorroborated accounts, but without whom the defendants had no case at all.
