Defendant Officers pulled plaintiff off the bench where he was seating and unlawfully handcuffed plaintiff without probable cause or legal jurisdiction. Defendants transported plaintiff to 75th Precinct against his will, where at he was unlawfully searched and interrogated by defendants. Defendants then transported plaintiff to the 73rd Precinct against his will, whereat he was unlawfully searched, fingerprinted, photographed and detained in a filthy holding cell for many hours. On June 19,2021 plaintiff was arraigned in Court and charged with criminal possession of a weapon. Late that day bail was granted. On July 9,2021, Plaintiff’s bail was increase which he could afford, he was then sent to Riker’s Island. Plaintiff was unlawfully detained for 15 days on Riker’s Island. His cousin was in the driver's seat and the engine was on. Officers pulled up and told them they were stopped because the car was in front of a fire hydrant. The officers falsely claimed they smelled marijuana and then asked them all for identification. Plaintiffs cousin gave permission to search the car. When officers searched the trunk, plaintiff took issue as they could not see the search and officers could plant contraband. Plaintiff and the other men were then removed from the car, searched and placed under arrest. Plaintiff's cuffs were excessively tight and he requested they be loosened but was denied. Plaintiff was then taken to the precinct, where he was told he ewas arrested because officers had found a fraudulent card in the trunk. Plaintiff remained in excessively tight cuffs for an additional 35 minutes before htey were removed. He was taken to central booking and held for other 24 hours before he was released. NYPD officers pulled up in their car and demanded that Plaintiff approach and show Plaintiff’s identification. The officers jumped out of their car and told Plaintiff to raise his hands. Plaintiff and Plaintiff’s friend’s car were searched, and no illegal substances were recovered. Plaintiff was held at the scene for approximately thirty minutes while additional officers arrived and searched the nearby sidewalk, house, and yards without probable cause. Eventually, the officers claimed to have found a weapon not in his possession or his vicinity and placed Plaintiff under arrest. Plaintiff was arraigned under a criminal court complaint signed by Defendant Mixon charging Criminal Possession of a Weapon in the 2nd degree. Four days later, he posted the bail and was released. The Kings County District Attorney’s Office advanced the case and dismissed it. \n\nOn July 11, 2012, Plaintiff was speaking with his child’s mother on the street when NYPD officers pulled up with their sirens flashing. The officers, including Defendant Keville, demanded what to know Plaintiff was doing there and took his identification. Plaintiff was searched, and no illegal contraband was found. The officers then began to question Plaintiff about a truck that was parked nearby. Plaintiff repeatedly denied owning the truck or knowing anything about it. Defendant officer then grabbed the keys that Plaintiff had on him and tried to open the truck, but could not. Plaintiff was then placed under arrest and handcuffed without any warrants or probable cause. When Plaintiff asked why he was being arrested, Defendant officer responded, “I don’t know yet.” Plaintiff was taken to the precinct and eventually processed through central booking.
