PO Dominick Martorelli and PO Fausto Gomez arrived at the apartment building and met Plaintiff in the vestibule. PO Gomez told Plaintiff that he could not enter the apartment and that he was going to be taken to the hospital since he had been drinking. PO Martorelli approached Plaintiff and handcuffed him while PO Gomez held Plaintiff in place. Neither PO Gomez nor PO Martorelli told Plaintiff whether he was under arrest or read his Miranda Rights. PO Gomez and PO Martorelli unlawfully escorted Plaintiff outside the apartment building. Plaintiff repeatedly asked why he was being arrested and asked PO Martorelli why they were taking him handcuffed. Plaintiff indicated that the officers were being racist. Upon hearing this statement, PO Martorelli lifted Plaintiff by the elbows and slammed him against a glass window. Plaintiff sustained a laceration to his ear, the side of his head, and his right elbow. Plaintiff was placed in an ambulance, still handcuffed. Plaintiff asked multiple times that the handcuffs be removed as they were too tight and hurting him. PO Gomez and PO Martorelli refused. Plaintiff was admitted and treated at the hospital for his injuries, but no charges were pressed against him.
