Plaintiff was attempting to access an apartment to gather his belonging but was unable to enter because the locks had been changed. Plaintiff had been temporarily staying in the apartment with his cousin while the elevators in his cousin's building were being repaired because his cousin was disabled and could not walk up the stairs. Plaintiff explained this to the officers and informed them of the fact that the superintendent of the building was aware of his lawful presence. The officers refused to contact the superintendent of the building, claiming to have contacted the superintendent of the apartment complex (who was unaware of Plaintiff's situation), and instead unlawfully handcuffed and falsely arrested him without probable cause. Officers then transported Plaintiff to the precinct against his will, where he was unlawfully strip searched, searched, fingerprinted, photographed, and detained in a holding cell for many hours. He was then transported to Central Booking where the unlawful detention continued. Officers provided the DA with false, misleading, and incomplete evidence and information regarding the facts and evidence. Upon this false information, Plaintiff was maliciously prosecuted and denied the right to a fair trial. Plaintiff was arraigned on February 13 and charged with crimes that lacked probable cause. Based on the false allegations the Court set bail that the Plaintiff was unable to pay. Plaintiff was not released from custody until March 20, 2020 and which point he was released due to the COVID outbreak.
