Both plaintiffs were handcuffed excessively tightly and arrested without probable cause. The officers did not read them their rights or offer a summons but instead transported them to the 28th Precinct in a prisoner transport vehicle, where they were detained for 5-7 hours, subjected to unreasonable large-scale arrest processing due to their involvement in the protest. Plaintiffs were not offered any phone call while in custody. Plaintiffs exited their vehicle and approached the two uniformed men, Defendants Palacios, Pal, and a third-party, and inquired why they were standing on their driveway. Plaintiffs explained they had a restraining order against the third-party (present on the driveway) and this third-party was not allowed to interfere with Plaintiff’s ownership and use of the driveway. Palacios and Pal, refused to leave Plaintiffs’ property and insisted they were conducting “an investigation” and Plaintiffs had to produce driver’s licenses. Pal confronted Irina and physically separated her from her husband. Pal began to yell at Irina in an intimidating manner, standing five inches from her face shouting, “This is an investigation, Madam!” Pal made an emergency call for additional officers. Two new Defendant officers improperly approached, touched, assaulted and battered Irina without cause. Plaintiff John was kept away from his wife against his will and, when he objected to the treatment his wife was receiving, was told he was under arrest, handcuffed, and brought to the 61st Precinct. A criminal complaint was filed against Plaintiff John by Palacios in which Palacios wrongfully claimed John, “recklessly engage[d] in conduct which created a grave risk of death to another person…[and Palacios] had to jump out of the way to avoid being hit by Defendant’s vehicle.” Plaintiff John was imprisoned for three days and two nights at three locations due to the fabricated evidence and lies by Defendants. \nPalacios testified to a Grand Jury on February 8, 2012 with the same allegations. Plaintiff Irina was charged with disorderly conduct. On February 10, 2012, Plaintiffs presented the Brooklyn DA with a “time stamped” videotape, showing the claims Palacios made in filing criminal charges against Plaintiffs had no basis in fact or law. After news of the false charges filed by Palacios against Plaintiffs spread, on February 28, 2012, the DA agreed to dismiss criminal charges against Plaintiff John. Several weeks later, the DA agreed to dismiss the disorderly conduct charge against Irina.
