Ashmeade drove himself to Jamaica Hospital, where he was treated. Ashmeade explained to doctors he had simply been walking when he heard the gunshot, realized it was he who had been shot, and immediately took himself to the hospital. NYPD officers Michael O’Sullivan, Brendan Parpan, Kevin Pugliese, and James Fleming responded to the hopistal and questioned Ashmeade regarding the identity of the person who had shot him and for the location of the gun. Ashmeade told officers he didn’t know the answers to their questions. The P.O.s insisted Ashmeade knew something he wasn’t telling them and handcuffed him to his hospital bed while continuing to question him. P.O.s stated if Ashmeade couldn’t tell him who had shot him, then he must have shot himself which meant he had the gun. Ashmeade remained detained and handcuffed to his bed from January 24 to January 27. \n\n\nP.O.s charged Ashmeade with two counts of criminal possession of a weapon in the second degree, two counts in the fourth degree, and one count of reckless endangerment in the first degree on their baseless theory Ashmeade shot himself If he wouldn’t tell them who shot him. No weapon was ever found for them to charge him off of. P.O.s presented false evidence that Ashmeade had told them he shot himself. This did not match the statement he had reported to the hospital. P.O.s fabricated their charges and evidence and forward it to the DA. On January 27, 2021, Ashmeade was taken from the hospital to Central Booking despite doctors stating he should not be moved in his condition. Ashmeade was taken in handcuff to Queens Criminal Court and arraigned, before being sent to Rikers and confined until January 29, 2021. While at Riker’s Ashmeade was placed with general population rather than in the infirmary. Ashmeade was forced to stand for long periods of time and denied access to a crutch which exacerbated his injury. On March 1, 2021, the DA informed Ashmeade’s lawyer that the claim Ashmeade stated his wound had been self-inflicted was inaccurate, and on March 4, 2021 the DA’s office dismissed the case.  Ashmeade’s car had been impounded during his arrest by the NYPD, when it was returned to him the entire dashboard was destroyed.
