During the incident, officers approached Plaintiff’s car with their guns drawn. Officers searched the vehicle; no contraband was recovered from Plaintiff or his vehicle. Nevertheless, Plaintiff was transported to a precinct and imprisoned therein. Plaintiff was imprisoned until January 11, 2013, when he was arraigned on baseless charges filed based on the false allegations of officer Garcia that Plaintiff had refused to follow his orders and had purportedly resisted arrest. Officers initiated and continued the prosecution with malice. They created and manufactured false evidence against Plaintiff and PO Garcia conveyed said evidence to the DA’s Office, causing the false evidence to be used against Plaintiff in a legal proceeding. As a result of the malicious prosecution, Plaintiff was compelled to return to court on two occasions. Officers broke down the front door to plaintiffs' apartment to arrest non-party Shakar Barksdale pursuant to an arrest warrant. Shakar Barksdale was sleeping on the living room couch. Officers saw Shakar in the living room. Officers handcuffed plaintiffs. Officers searched Shakar's bedroom and located a paintball gun inside of a suitcase. Defendants arrested plaintiffs, placed them in an NYPD vehicle, and transported them to the 25th precinct. After a few hours, plaintiffs were transported to Manhattan Central Booking. Defendants communicated false information to the NY DA regarding the bases for their arrest of plaintiffs. On November 4, 2011, Plaintiffs were arraigned and charged with crimes, then released from custody.  When Plaintiff Jahmella was arrested, her employer the NYC DoE was notified of her arrest, and suspended her without pay for one month and plaintiff suffered a loss of $1,800 of salary. Plaintiffs were each required to appear in criminal court 4 times before the charges against them were dismissed. On March 6, 2012, charges against Plaintiffs Anthony and Jahmella Barksdale were dismissed on motion of the DA.
