Because of plaintiff's appearance, defendant McCready referred to plaintiff using male pronouns, despite plaintiff's request to be referred to using female pronouns.\n\nOn or about December 12, 2016, McCready drove dangerously close to plaintiff, who was sitting in her parked car, and verbally threatened to hit plaintiff with the car.\n\nOn February 8, 2017, plaintiff was pulled over and searched three times in one day.\n\nOn March 8, 2017, Plaintiff was again pulled over by defendants Gagliardi, Brian Ritto and Craig Rosenberg. Defendant Rosenberg screamed at plaintiff to get out of the car and then threw the phone she was using to record the incident onto the ground. Rosenberg then placed plaintiffs arms behind her back and placed excessively tight handcuffs on plaintiff. The judge set bail, which plaintiff was unable to post, and plaintiff was remanded to Riker's Island. On August 16, 2017, the grand jury indicted plaintiff. While in custody at Rikers, plaintiff was assaulted by NYC Correction Officers and suffered physical injuries, including but not limited to pain to his ribs. On August 25, 2017, after 4 days in unlawful custody, plaintiff was able to post bail and was released from custody. Plaintiff was required to make five additional court appearances. An undercover officer confirmed the physical description of the subject, which did not match any of the Plaintiffs. On December 12, 2017 at approximately 6:00 a.m. up to 14 POs broke into Plaintiffs' home. Plaintiffs, a family, were in their various bedrooms preparing for school. POs broke open the door with assault weapons and some dressed in SWAT-style masks and gear. POs held various family members, including young children, at gun point. Plaintiff Isaac Okoli had a CPAP machine, which was pulled from his face before POs used undue force to throw him upside down, twist his arms, and handcuff him, causing injuries to Plaintiff Isaac Okoli's back, shoulders, arms, and wrists. Plaintiff Millycent Atuegwu was startled by the unknown individuals points guns at her, and in her panic she fell out of bed and injured her hip, leg, and back. \n\nFamily member G.O., a sixteen year old boy, was also ordered at gun point to get out of his bed and on the floor. Before G.O. could comply POs roughly dragged him out of bed to the floor and cuffed him, causing injury to G.O.'s shoulder. As G.O. was handcuffed and face down on the floor, they repeatedly asked his age. G.O. replied he was 16 but POs repeatedly told him he was lying because they believed him to be their suspect, despite the fact that their subject was estimated to be in his thirties. POs were unable to find contraband in the home, even though they brought a drug-sniffing dog. Plaintiffs were moved to the living room, where for the first time Plaintiff Victoria Okoli was allowed to fully cover herself with clothing. Plaintiffs over heard POs state they were in the wrong residence, yet they continue to detain the family and search the residence. POs attempted to cover up their unlawful invasion by fabricating that they found a small vial of cocaine at the residence, initiating a malicious prosecution. The District Attorney's office decline to prosecute and ultimately dismissed the charge. Additionally, about a year later, on September 9, 2013, the defendant officers stopped, detained, harassed, assaulted and arrested the plaintiff without cause while outside in Brooklyn.\n\nOn August 2, 2012, the plaintiff was engaged in a conversation with a friend when the defendant officers drove past them in a police vehicle. The officers then made an abrupt illegal U-turn to approach the plaintiff. The defendants began questioning the plaintiff and one of them asked the plaintiff \"don't I know you?\" The plaintiff informed the defendant officers that he didn't know any of them. Defendant officers then began to grab the plaintiff and reach into his pockets. The plaintiff requested that the defendant officers leave him alone as they were grabbing, turning pushing and pulling him. They refused and began to pounce on him and beat him up. The defendant officers proceeded to empty/spray several chemical agents onto plaintiff's face. Not contended, the defendant officers targeted and repeatedly punched the plaintiff in his periocular area causing the plaintiff to sustain, among other injuries, an orbital fracture and to experience diplopia. The defendant officers also kneed the plaintiff in his stomach area causing the plaintiff to pass blood in his urine, and forcibly dragged the plaintiff down to the ground. Eventually, defendant officers tightly handcuffed the plaintiff with his hands placed behind his back and forcibly pushed the plaintiff into a police vehicle. Plaintiff was rendered dizzy and unconscious as a result of the defendant officers' actions. Plaintiff was later transported to the NYPD Housing Bureau's PSA-2. Initially, defendant officers denied plaintiff's request for medical treatment, but, after a lengthy period of time plaintiff's conditions worsened and the defendant officers were forced to transport the plaintiff to a hospital. The defendant officers seized the plaintiff's belongings and did not provide him with any means to obtaining them again. Plaintiff was charged with resisting arrest and subsequently released. \n\nPrior to his second arrest on September 9, 2013, the plaintiff was eating dinner at his home with one of his friends when the defendant officers suddenly and unlawfully entered the plaintiff's home, arrested him and charged him criminal possession of a weapon. Defendant officers tightly handcuffed the plaintiff (which caused the cuffs to cut into plaintiff's skin) and denied each of plaintiffs' requests to loosen the handcuffs. The plaintiff was taken to the 77th Precinct and then transported to Central Booking to await arraignment. The defendant officers falsely stated to the prosecutors, among other things, that the plaintiff was in possession of a weapon. The prosecutors conducted an independent investigation and concluded that there was no evidence to support the defendant officers' claims, so the prosecutors declined to prosecute the plaintiff. The Defendants requested to see Plaintiff's identification which he provided, and upon reviewing the identification, they forcefully ransacked his body and clothing. When Plaintiff protested, the three Defendant officers attacked him and pushed him to the wall and twisted his hands behind his back. Plaintiff questioned his treatment and the officers responded by beating the Plaintiff, including punching and slamming his head against the wall. Plaintiff was then taken to the lobby with his hands cuffed, where Defendant officers dragged, kicked, and punched the Plaintiff all over his body. Defendants then dragged Plaintiff to a police vehicle and transported him to PSA2 Housing Precinct on Sutter Avenue in Brooklyn. While there, an ambulance was called to take Plaintiff to Kings County Hospital for emergency treatment. Plaintiff was diagnosed with multiple abrasions, contusions, cuts, lacerations, and a type 1 dental fracture. After receiving medication for the pain and dental fracture, Plaintiff left the hospital at about 11:00 a.m. and was taken back to PSA2 Precinct and then to Kings County Central Bookings. Plaintiff was arraigned on September 16, 2012 at approximately 11:00 p.m. and was charged with: Criminal Possession of Marijuana in the Fifth Degree, Unlawful Possession of Marijuana, Resisting Arrest, and Obstruction of Governmental Administration in the Second Degree.
