Plaintiff was eventually assisted in dressing herself by a female officer and again placed in handcuffs. Plaintiff was escorted to the living room as Defendant Officers and Officer Calderon searched the apartment. Calderon allegedly recovered a firearm, ammunition, and marijuana; however, Plaintiff asserts that none of this contraband was observable in plain view, none was in her possession, and none belonged to her. Plaintiff, who was pregnant at the time of the arrest, was taken to the the precinct and then central booking, where she suffered two anxiety attacks and an asthma attack. Plaintiff fainted after an officer sprayed her cell with air freshener. Plaintiff was incarcerated for approximately two days. Charges against Plaintiff were dismissed on May 15, 2018. Defendant NYPD officers, including Defendant NYPD officer Paolo Ruiz and Defendants John and Jane Doe 1-10, came to Plaintiff's residence without a warrant or probable cause seized and searched and falsely arrested Plaintiff and forced claimant to go to the police precinct. At the precinct the officers falsely accused Plaintiff of being involved in a burglary that took place inside the Academy of Public Relations, a school located at 778 Forest Avenue, Bronx, NY on March 12, 2014. Plaintiff told the officers that the was sleeping during the time of the robbery and when Plaintiff was arrested Defendants had in their possession video footage of the burglary suspects. The suspects' faces can be viewed clearly and even to the casual observer it is obvious that Plaintiff was not one of the people in the video. The Defendants Ruiz and Defendant Police Officer Calderon falsely told the Bronx County District Attorney's Office that Plaintiff committed a burglary. The Defendants then sent these false allegations to the DAs Office in order to justify the unlawful arrest of Plaintiff. After Plaintiff was taken to the precinct, then Plaintiff was taken to Central Booking and arraigned and remanded to Riker's Island. While incarcerated at Riker's Island on or about April 14, 2014, Plaintiff was attacked by a fellow inmate. Defendants John/ Jane Doe of New York City Department of Correction Officers, knew that Plaintiff reasonably feared for his safety but refused to act or prevent any harm from coming to Plaintiff and refused to prevent any harm to Plaintiff. Defendants were aware of a risk to Plaintiff's safety and a need for medical care and failed to act in deliberate indifference to Plaintiff's needs. Plaintiff was caused pain and suffering and injuries and was taken to Bellevue Hospital for a broken jaw and had to undergo surgery. Plaintiff was incarcerated at Riker's Island for approximately 51 days. Plaintiff appeared in court as required and on December 1, 2014, and then Plaintiff's criminal case was dismissed in its entirety. Plaintiff was taken to the 5th Precinct and ticketed for disorderly conduct.  The summons was dismissed on March 19, 2011.\n\nOn March 17, 2011, Plaintiff was present at Zuccotti Park when police cleared the protesters.  While restraining Plaintiff, Defendant Officer Eddy Calderon bent Plaintiff’s thumb back and broke it.  Later, while restrained on the ground, another officer stomped on Plaintiff’s face twice.  Plaintiff was later thrown on the floor of a bus to be taken with other protestors for processing.  Despite Plaintiff’s requests for medical attention, which included bleeding from his ears, no care was provided for 12 hours.  While at the hospital Plaintiff was overseen by Defendant Officer Daniel Perez.  While being taken back to the precinct, Defendant Perez pushed Plaintiff against a police van, choked him and pressed a finger into the ear that had been bleeding earlier.  Defendant Perez later removed Plaintiff’s thumb splint and threw it away, despite the broken finger.  Plaintiff was eventually given a second trip to the hospital after many hours of pain and requests for aid.   Plaintiff was eventually taken before a judge after 48 hours on March 19, 2011, and released.\n\nOn May 1, 2012, Plaintiff was at another protest when he was again arrested.  During that arrest some of his personal items were taken and not returned.  Due to confusion about the Plaintiff’s name as he used a different name during the earlier arrests but was using his legal name now, resolution was deferred.
