Plaintiff was employed as a contractor with a construction company and was in PA for a construction job. Approximately two months before the incident, on March 19, 2019, Plaintiff was in a bodega in County of Kings, New York, discussing a possible construction expansion job. While inside the bodega, Plaintiff observed some young men running past the windows outside and left the bodega when he heard shots fired. Almost two (2) months later, on May 8, 2019, the Plaintiff was in Harrisburg, PA for a different construction job when approximately five Defendant Police Officers descended upon him and began to arrest him. Plaintiff was unlawfully arrested, handcuffed, and subjected\nto unlawful pat-down search by defendant officers without legal justification or probable cause. Defendant Officers then transported Plaintiff against his will from Harrisburg, PA back to the NYPD 75th Precinct, where he was unlawfully fingerprinted, photographed, and placed in a holding cell. Plaintiff was informed that he was being charged with Conspiracy to Commit Murder pertaining to the events of March 19, 2019. Defendant police officers falsely stated to the Kings County District Attorney's Office that Plaintiff was guilty of Conspiracy to Commit Murder, Manslaughter in the First Degree, and Assault in the First Degree. Shortly thereafter, Plaintiff was remanded to Rikers Island Correctional Facility to await trial and was forced to be incarcerated at Rikers during the Covid-19 Pandemic.\nJudge Vincent M. Del Guidice granted Defense Counsel's motion, released Plaintiff after 8 months unlawfully in custody nothing that Plaintiff is 20 years older than any of the participants in the crime.
