At the 46th Precinct, Defendant Nikqi created police reports falsely claiming that Breton possessed a loaded firearm, marijuana and a plastic tube. As a result of the false police reports and property clerk invoices, Breton was charged by the BCDA with Criminal Possession of a Weapon in the Second Degree and related firearms offenses, and Unlawful Possession of Marijuana. On July 1, 2022, the prosecution terminated favorably for Breton when a jury returned a verdict of not guilty. Officers knew that the plaintiffs did not commit any crime or offense, yet did nothing to intervene.
