Plaintiff was in the backyard, along with several other people, when multiple police officers entered the backyard with guns drawn. The officers placed Plaintiff and several others against a wall, searched them, and handcuffed them. Plaintiff was not in possession of any contraband, but the officers put him in a police car and took him to a local area station house. Plaintiff repeatedly asked why he was being arrested, but no answer was given. While in custody at the station house, Plaintiff spoke with Defendant Ortiz, who wanted Plaintiff to provide him with information as his confidential informant. Plaintiff declined. Eventually Plaintiff was transported to Central Booking in Kings County, where he was imprisoned for many hours. While imprisoned, Defendant Ortiz completed arrest paperwork that falsely claimed that he had spoken with Defendant Byrne who alleged that he recovered a handgun from Plaintiff's waistband and that he (Ortiz) personally observed that the gun was loaded. Defendant Ortiz forwarded the false allegations to the Kings County District Attorney and the Plaintiff was criminally charged with three separate counts of criminal possession of a weapon. Plaintiff was arraigned and bail was set, but Plaintiff couldn't post bail and was sent to Rikers Island.
