The plaintiff had never seen the individuals before and had no relationship to them. When the plaintiff thereafter entered a pizza place, unnamed Police Officers John Doe #1-10 and Police Office Vince Vacca grabbed the plaintiff by his shoulders and forcefully pulled him outside the pizza place onto the sidewalk. The officers then searched the plaintiff and handcuffed him without probable cause. The plaintiff was then transported to a nearby precinct where he was fingerprinted, placed in a cell, subjected to an unlawful invasive strip search, and charged with Criminal Possession of Stolen Property in the Fifth Degree. The plaintiff was then transported to Central Booking and then to Rikers Island, where he remained in custody for five days. The defendant police officers filled out false and/or misleading police reports and forwarded them to prosecutors at the Bronx Country District Attorney’s Office, repeatedly giving false and misleading information regarding the facts about the plaintiff’s arrest, thus denying the right to a fair trial. Specifically, Police Officer Vince Vacca falsely stated that the plaintiff unlawfully possessed stolen property (the TV and shopping cart) despite never observing the plaintiff commit any crime. As a result of his unlawful arrest, the plaintiff spent six days in custody and sustained physical injuries.
