Plaintiff was falsely accused of possessing illegal contraband. Because Plaintiff did not know the people approaching him were officers, he became alarmed by their aggression and began to run for his safety. The officers chased and caught him. All officers in the vicinity shoved him to the ground and beat him. Plaintiff never resisted arrest. The officers continued to assault plaintiff while he was handcuffed. The plaintiff lost consciousness while he was being assaulted. The defendants never displayed law enforcement credentials. Officers Genco and Martinez approached Plaintiff and subjected him to a pat-down search. Officer Martinez detained Plaintiff. Officer Genco then asked Plaintiff to sign a document permitting the Officers to search an apartment in the building at 2160 Matthews Avenue. Plaintiff was not a resident of the apartment and declined to sign the document. Officers Genco and Martinez then arrested Plaintiff. Officers did not have a warrant authorizing the arrest. Plaintiff was subjected to another pat-down search and was handcuffed and then placed in a vehicle and taken to the building at 2160 Matthews Avenue, where the Officers detained Plaintiff for an extended period of time. Plaintiff was then taken to a police precinct then to a facility known as the Tombs where was imprisoned. On August 7, 2013, Officer Genco falsely informed an Assistant District Attorney that Plaintiff had exercised dominion and control of more than eight ounces of heroin and other items used to package narcotics in the Matthews Avenue building. On that same day, Genco instituted a criminal proceeding against Plaintiff and Plaintiff was arraigned and then imprisoned in lieu of bail. Plaintiff was subsequently indicted by a grand jury. On or about December 6, 2013, a judge ruled that there was insufficient evidence to support the charges and released plaintiff on his own recognizance.
