At that time, Plaintiff was smoking a cigarette when he was approached by Defendants, including Balena, An, and Bradshaw, who illegally approached and stopped Plaintiff. Defendant Officers then grabbed the cigarette from Plaintiff’s hands without asking. Defendants then demanded and took Plaintiff’s identification, went to their police vehicle, returned, and accused Plaintiff of a criminal offense without reasonable suspicion or probable cause. Defendants then illegally seized, detained, and searched Plaintiff. Defendants then proceeded to violently contort Plaintiff’s arms behind his back so that they could tightly apply metal handcuffs.
