Defendants knowingly and intentionally decided to fabricate claims to justify an otherwise invalid arrest and to ensure that Plaintiff was maliciously prosecuted. The arrest and prosecution were not based on any belief that the Plaintiff committed a crime, but rather motivated by a desire for retribution against the Plaintiff for his prior successful lawsuit against the Defendants. Post arrest plaintiff was brought to 43rd precinct where he was illegally searched, including a strip-search with cavity inspection, questioned, photographed and fingerprinted. Defendant Dorch was the arresting officer who falsely accused plaintiff in retaliation to the lawsuit brought by the plaintiff that contributed to the disciplinary action levied against him as well as his forced and involuntary assignment to the Bronx Criminal Court Section. After his arraignment, the Plaintiff was transferred to Riker's Island, where he was unlawfully detained until his release around December 1, 2018. He was compelled to return to court multiple times to contest false charges, including Criminal Possession of a Firearm, Criminal Possession of a Weapon in the Fourth Degree, and Possession of Ammunition. On December 19, 2018, all charges were unconditionally dismissed.
