The following day, on October 8, while visiting his deathly ill mother at the hospital, Plaintiff was asked by the defendant NYPD Officers to come to the 73rd Precinct for some questions. Plaintiff agreed and arrived at the the precinct at approximately 8:30 pm. For the next 27 hours, until 11:00 pm on October 9, Plaintiff was interrogated by defendant NYPD Officers Erick Parks, Elena Gonzalez-Munoz, Salvatore Triscritti, and John Herbert as well as FDNY Officers Orlando, Constantine Kanelopoulos, and Eric Hansen, who ignored Plaintiff's request to leave and return to his hospitalized mother and his request for an attorney. Despite Plaintiff repeatedly telling Defendants that he was not present when the fire started, Defendants continually engaged in coercive tactics including conditioning Plaintiff's ability to see his mother on his confession, promising Plaintiff protection, and leaving Plaintiff in the interrogation room for a long period of time. At one point, Defendants placed a call to Plaintiff's ill mother to further coerce Plaintiff. \n\nThrough their use of illegal methods, Defendants coerced Plaintiff into giving false verbal and written statements. After giving a false confession, Plaintiff was taken to Kings County Central Booking. Defendants intentionally and knowingly provided Plaintiff's false confession to the DA's office. During that time, Plaintiff's mother passed and Plaintiff did not get a chance to see his mother again. Due to these false charges, Plaintiff was arraigned, had bail set, and was incarcerated on Rikers Island. The next day, Mr. Moore was visiting his terminally ill mother in the hospital when the defendant officers arrived and told him he had to go to the precinct. Mr. Moore left voluntarily, gave his statement at the precinct, then requested to leave so he could return to his ill mother. The officers refused and detained Mr. Moore against his will. \n\nThey detained him throughout the night and told Mr. Moore he could not leave unless he said what the defendant officers told him to say. The officers wanted Mr. Moore to admit to starting the fire by accident. The following morning, the officers called Mr. Moore's ill mother and put her on speaker phone to further convince Mr. Moore to admit to starting the fire. Later that day, the officers coerced Mr. Moore into giving a false statement, videotaped confession, and written confession in which he admitted to events that did not occur. Instead of releasing Mr. Moore as promised, they transported him to central booking where he was arraigned for crimes he did not commit. Mr. Moore's mother passed before he was released, and he was incarcerated for over 5 years as a result of this incident.
