Plaintiff was standing on the sidewalk taking photographs and videos of the protest when Defendants then grabbed, handcuffed, and arrested the plaintiff without legal justification or excuse. The plaintiff was then transported to 1 Police Plaza and later to the Central Booking where he was confined to a holding cell for approximately 6 hours. While in custody, the plaintiff was deprived of food and water during the whole time. The Plaintiff was issued a Criminal Court Appearance Ticket with a return date of September 25, 2020, charging him with Disorderly Conduct. The plaintiff was notified by mail that all criminal charges were dismissed and sealed in his favor prior to the return date of September 25, 2020. As a result, the plaintiff suffers ongoing emotional and psychological trauma. The second incident occurred on June 2, 2020, at approximately 9:00 P.M., where Plaintiff was lawfully attending a peaceful protest and was legally walking on the street in the vicinity of 15th street and 66) Avenue and was filming an altercation between a female protester and police officers while standing on the sidewalk. Defendant Officers approached Plaintiff from behind, hit his forearm and fingers with a baton, and threw him onto the ground. Defendants then kicked the plaintiff repeatedly while he was on the ground and was handcuffed. Defendant Officers also destroyed Plaintiff's cellular phone while they were assaulting him. Defendants transported Plaintiff to 1 Police Plaza and released him later. As a result, plaintiff had to seek medical treatment at CityMD right after he was released from custody due to his injuries from the defendant’s assault.
