When approached by police, Plaintiff indicated to defendant P.O. Hoxha, and NYPD Officers John Doe #1-5 that he was not the person they were looking for, and that he had not robbed anyone. Defendants never reviewed the videotape from the scene and arrested Plaintiff.\n\nPlaintiff was charged with Robbery 3rd degree, Criminal Possession Stolen Property 5th Degree, Petit Larceny, Harassment, and Menacing. Defendants knew or should have known Plaintiff was innocent or at least inquired into the matter prior to making any arrest. Defendants possessed or had access to information that would have demonstrated that they were arresting the wrong person. After Plaintiff's arrest she was subjected to a search of the intimate parts of her body causing embarrassment and humiliation.\n\nWhile transported to central booking, Defendants penetrated multiple assault and batteries upon Plaintiff, including handcuffing excessively tight and refusing to adjust the restraints despite demands for them to do so. Defendants prepared false sworn affidavits and false police reports. Defendants later provided false and incomplete information despite knowing they lacked a legal and factual basis to allege Plaintiff committed any crime. Plaintiff was eventually unlawfully detained for 7 months before being released. While incarcerated Plaintiff was assaulted by other inmates.
