Known prostitute and drug user Asia Booker was blocking his door and actively smocking crack cocaine and marijuana in front of it. Plaintiff attempted to enter his apartment and asked Ms. Booker to not use drugs in front of his apartment. As Plaintiff was opening his door Ms. Booker punched and kicked Plaintiff, and struck him with her crack pipe which caused a significant and bleeding laceration to Plaintiff's eye. Plaintiff managed to access his apartment, closed the door to end the assault, and called 911 to inform them of the assault. Ms. Booker, hearing the call, fled the building. PO Franklin Cerda, Det. Volney JeanJacques, Sgt. Valerie Visco, Sgt. Robert Taylor, Sgt. William Rentas, Sgt. Feliz, Sgt. Ron Sawers, and/or PO Cummings responded, saw Plaintiff's injuries, and acknowledged his version of events was consistent with the physical evidence. POs also acknowledged they knew Ms. Booker to be a drug user and prostitute. POs canvassed the complex and found Ms. Booker outside, where they placed her under arrest. Ms. Booker was not injured by Plaintiff and did not herself call 911. However, Ms. Booker falsely claimed Plaintiff attacked her and POs arrested Plaintiff based on her false allegation. POs knew the allegation to be false but arrested Plaintiff regardless because many of the POs regularly paid for sex with Ms. Booker and purchased drugs for her in order to keep her happy and not report their criminal behavior. \n\nPlaintiff was transported to PSA 6 where an ambulance was called for Plaintiff's injuries. Plaintiff ultimately required transportation to the hospital for further treatment. After receiving medical treatment at the hospital, Plaintiff was transported back to PSA 6 and maliciously prosecuted. After approximately 24 hours in custody Plaintiff was arraigned and charged with assault. Plaintiff was initially unable to make bail and spent approximately 3 days at Riker's Island before he could make bail. At arraignment the court ordered an order of protection against Ms. Booker. \n\nOn March 3, 2013 at approximately midnight Plaintiff was again lawfully present in his apartment when his doorbell rang. Plaintiff opened the door to Ms. Booker and another woman, who both unlawfully entered Plaintiff's apartment, assaulted him, and stole his cell phone. During the assault Plaintiff shouted for his neighbor to call 911. PO Franklin Cerda, Det. Volney JeanJacques, Sgt. Valerie Visco, Sgt. Robert Taylor, Sgt. William Rentas, Sgt. Feliz, Sgt. Ron Sawers, and/or PO Cummings responded and arrested the two women for violating the protective order and for assaulting Plaintiff. POs also unlawfully arrested Plaintiff, though it was clear Plaintiff was inside his home and could not have violated the order of protection. Plaintiff was transported to the hospital for treatment of injuries sustained during his assault then was taken to PSA 6, where POs falsely initiated a second malicious prosecution against Plaintiff. Plaintiff was arraigned after approximately 24 hours in custody and was again unable to make bail. \n\nOn or about March 20, 2014 Plaintiff was released from custody, at which time he arrived at his apartment to find his beloved dog had died of starvation due to his unlawful incarceration. POs had refused to help Plaintiff get aid to his dog during Plaintiff's unlawful incarceration. On May 20, 2013 charges related to the January 7, 2013 arrest were dismissed and on July 18, 2013 all charges related to the March 3, 2013 arrest were dismissed.
