When Plaintiff pulled up in front of his home, defendants, NYPD officers approached his car with their guns drawn. Plaintiff scared honked his car to alert his family. Plaintiff's father exited the house and then Plaintiff opened the car door and when he did the NYPD officers John and Jane Does, Dustin Diaz and Mark Whirl dragged him out of his car and physically assaulted him, causing injuries to his body and face and then arrested him. Plaintiff was also tasered and struck. Defendants hit plaintiff's head, pounded his head and body into the street. Plaintiff was also wrongfully arrested. The criminal charges were dismissed on August 12, 2024. Two defendants, NYPD officers Dustin Diaz and Mark Whirl gave conflicting accounts of what led to their decision to arrest the plaintiff, and based on this NYPD officers maliciously prosecuted the Plaintiff. There were also video recordings of the incident, and these videos undermined Defendants' account. During these raids, defendant police officers drew weapons against the plaintiffs and their dog, who they would forcibly kick and threaten to shoot/kill. As a result of each of these raids, plaintiff Abram’s son, Mike Josie, was arrested at the premises, transported to NYPD police precinct(s), and falsely charged with numerous crimes (all of which were eventually dismissed and sealed). Plaintiff was arraigned on June 27, 2019 and eventually released on his own recognizance. Plaintiff appeared before the criminal court on multiple occasions to defend against the charges levied against him. On or about October 31, 2019, the false charges were dismissed because of a lack of evidence. On August 1, 2019, Plaintiff was again arrested without probable cause, grabbed, pushed, and handcuffed tightly, and brought to a precinct where he was interrogated. Prosecutors declined to prosecute plaintiff. On December 30, 2020, Plaintiff was again arrested without probable cause, pointed their guns at him, yelled, grabbed, pushed, shoved, and tightly handcuffed him to the point of numbness. Defendants brought Plaintiff to a precinct and interrogated him again. Defendants brought false charges against Plaintiff which were later dismissed on or about April 20, 2021 for a lack of evidence.
