Nevertheless, Defendants handcuffed and arrested Plaintiff without warning, explanation, probable cause, or justification. \n\nDefendants concocted bogus criminal charges, created a voucher which stated that Defendants removed a dagger from Plaintiff’s person during the search, charged Plaintiff with Criminal Possession of a Weapon in the Fourth Degree, and claimed that Plaintiff had been wearing a “dagger on a string tied around his neck,” all of which were not true. Defendants never advised Plaintiff of his Miranda rights at any time. Defendants P.O. KEVIN CARNEY and P.O. PATRICK COTTERS transported plaintiff PRISCILLA COLON to the 48th Precinct of the New York City Police Department in Bronx, New York. At the 48th Precinct, defendants P.O. KEVIN CARNEY and P.O. PATRICK COTTERS placed plaintiff PRISCILLA COLON in a cell still wearing the too-tight handcuffs. When plaintiff PRISCILLA COLON asked to have the handcuffs removed, defendant P.O. KEVIN CARNEY grabbed his crotch and suggested that plaintiff fellate him. At the 48th Precinct, without provocation, defendant P.O. KEVIN CARNEY sprayed plaintiff PRISCILLA COLON with a chemical agent. Defendants SGT. LOUIS BARBARELLI, and SGT.
