Plaintiff was carrying a book bag at a corner when a vehicle operated by the NYPD stopped parallel to Plaintiff and two officers including Police Officer Jeremiah Ramos approached Plaintiff. Officer Ramos was wearing a Carhartt jacket and not in uniform. Officers asked Plaintiff for an I.D. without probable cause, Plaintiff complied and officers informed Plaintiff there was a bench warrant for him. This warrant was from 1995 and Plaintiff informed Officers that and in actuality all warrants against Plaintiff were vacated as part of his prior criminal dispositions. Officers walked Plaintiff over to their vehicle and three other officers arrived on foot. At this time, officers turned on their body worn cameras. Plaintiff was placed in tight handcuffs, taken to a precinct, and had his bag searched which produced legally prescribed medications. Officer Ramos falsely filed charges of possession of a controlled substance. Plaintiff was placed in jail and forced to attend repeated court dates. The court ultimately dismissed the charged against Plaintiff.
