There was no public street on the City’s official acquisitions map on lot 162 when Kris bought it. Between 2006 and 2017, Gounden has had numerous contacts with police regarding the private nature of the entire lot. The City of New York filed suit against Kris to have his fence removed, claiming an easement existed. On May 29, 2013, the Environmental Control Board affirmed an ALJ’s decision, that there was no street on lot 162. In 2010, Kris fenced off his lot with a boulder and the Fire Department of the City of New York ordered the boulder removed on the ground that a boulder on private property constituted a fire hazard from accessing Kris’s eastern neighbors’ private lots. However, 60 yards from Kris’s northern boundary of lot 162 there are at least 10 houses with fences that prevent fire trucks from access – there was also a mapped public walkway to the east of Kris’s property by which fire hoses and emergency personnel are fire plan approved to Kris’s eastern neighbors’ houses. Since the Fire Department’s condemnation on Kris’s Property in 2012 or 2013, neither the Fire Department nor the City of New York has instituted Eminent Domain Procedure Law proceedings to map a public easement or public street on lot 162. On August 8, 2013, the City effected Kris’s arrest on the City’s policy that §189 of the Highway Law is applicable within the confines of the City of New York.\n\nOn Sep 9, 2013, Kris filed a Notice of Federal removal of the civil aspects of his criminal case. On Feb 10, 2014, Kris filed CPL 170.25 motion proposing a schedule in setting a date within which Kris was to file a 170.25 motion to Superior Court for prosecution by indictment – the motion detailed the complete lack of competence of a local Criminal Court to do anything other than set a date within which Kris was to file a 170.25 motion to Superior Court for prosecution by indictment. On August 8, 2013, P.O. Inspector Pascale ordered Gounden arrested and Plaintiff immediately sat on Gounden’s van. Plaintiff explained to Inspector Pascale that Plaintiff was Gounden’s agent authorized to protect his land against trespass. Plaintiff was arrested on the basis that Lot 162 contained a public street or easement, which was false. \n\nOn or about August 14, 2013, Plaintiff appeared before Judge Golia of the Criminal Court, wanting to set a date by which Plaintiff was to file a motion to the court to be prosecuted by indictment on Pascale’s arrest. Golia denied the motion and set a date for Plaintiff to return to local criminal court on October 17, 2013. On September 9, 2013, Plaintiff filed a Notice of Removal to the Eastern District and served Golia with the removal notice.
