Defendants then arrested Plaintiff Medina and handcuffed her, despite Medina not engaging in any unlawful behavior.  Medina was brought to a precinct where she was placed into a cell with other female prisoners for several hours, before being transported to central booking.  On March 21, 2019, she was arraigned and charged with Assault in the Third Degree, Obstructing Governmental Administration, Resisting Arrest, and Harassment in the Second Degree. Plaintiff's brother was a fugitive from Georgia wanted on violent felony charges. A joint task force of Deputy U.S. Marshals, including William Dundon, and NYPD Officers, including Gordon Brown. Dundon ordered Plaintiff out of the vehicle by Dundon and Brown. When exiting the rear passenger seat, Plaintiff was violently assaulted by Dundon and Brown. The two slammed Plaintiff's head against the rear passenger-side window of the vehicle twice, intentionally and seriously injuring Plaintiff, who had not resisted or engaged in any conduct warranting such force. Plaintiff's hands were handcuffed behind his back. Plaintiff was disoriented and dizzy as a result of having his head slammed into the window. Dundon and Brown frisked and searched Plaintiff, allegedly found a loaded firearm, and arrested Plaintiff for possession of the loaded firearm. Plaintiff was transported to 100 Centre Street for arraignment, bail was set at $75,000 bond/$75,000 cash, and Plaintiff was remanded into custody. \n\nPlaintiff started suffering from headaches, and went to the clinic at the jail where he was being held. Plaintiff was given Tylenol, which did not help. On February 19, 2015, Plaintiff woke up with a severe headache and vision loss in his right eye and was transported to Bellevue Hospital. An MRI revealed a tumor in Plaintiff's pituitary gland, which had been completely asymptomatic, but because of the blows to Plaintiff's head, blood vessels in the region broke and bled, causing severe headaches and loss of vision. Plaintiff underwent surgery to remove the tumor and address the bleeding. Plaintiff's vision remains impaired.
