During the raid, the officers, inter alia, pointed guns at Plaintiffs, performed illegal detentions and searches, failed to provide Miranda rights, used excessive force, failed to allow Plaintiffs to put on proper clothes before they were taken outside, and unlawfully arrested several of the Plaintiffs. Once all residents had been removed from the premises, officers, without consent or a warrant, conducted a full search of the premises that went on for several hours. Later, after returning to the premises, the Plaintiffs found that the premises was severely damaged and that their personal property was missing and/or broken. At the time the complaint was filed, one of the Plaintiffs had not received his confiscated wallet and keys back.  \n\nIn connection with the raid, several of the Plaintiffs were transported to the precinct, where they were held for hours, and then to central booking. All of the Plaintiffs who were brought to the precinct and central booking, except two, were released without being arraigned or charged. The two other Plaintiffs were charged and arraigned; their charges were still pending at the time the complaint was filed and they had pled not guilty to all charges. Various members of the NYPD arrived and spoke with the tenant. Shortly thereafter, the officers, including Charles Minch, John Portalatin and Nicholas Marciano, entered the apartment where the party was taking place and demanded that everyone leave. Mr. Jowers was outside when an officer approached him and demanded that he be searched. He complied and permitted the search, even though there was no lawful basis for the search. The search yielded no weapons, drugs or any other contraband. Despite the lack of evidence, the officers seized and handcuffed Mr. Jowers. Officer Marciano was the arresting officer. Officers Minch and Portalatin are believed to be the supervising officers on the scene who directed or otherwise approved the arrest. \n\nMr. Jowers was taken to a local area NYPD station house, where he was imprisoned in a holding cell. While at the station house, Mr. Jowers was searched again, finger printed and processed. He was held there for many hours before being transported to Central Booking, where he was kept for a further period of hours. Eventually the Kings County District Attorney's Office declined to prosecute Mr. Jowers and he was summarily released.","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nyed.350836.10.0.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/6185665/jowers-v-city-of-new-york/"},{"officer_name":"Minch, Charles","disposition":"Settlement","start_date":"2009-07-02","disposition_date":"2016-05-26","court":"Supreme Court - Queens","docket":"005441/2009","name":"Havens, Khalif By Fng Havens, Carl vs Minch, Charles, et al.","payout_amount":3000}],"image":"https://www.50-a.org/images/officer/VC6T-charles-minch.jpg","payroll":{"salary":"227306","regular":"220568","overtime":"11771","other":"41710","total":"274049"},"id":"VC6T","url":"https://www.50-a.org/officer/VC6T"}
