On the street, Clotter started talking to some women and Martinez was on the phone with his girlfriend. They noticed a rowdy crowd forming near them, and decided to walk in the opposite direction to avoid the crowd. As they walked away, PO Tolomy Cain and John Does 1–3 confronted them, ordered them to put their hands behind their back, and rear handcuffed them. Despite having no probable cause or reasonable suspicion, the officers put them in an NYPD vehicle and took them to the precinct. They were then taken to the Manhattan Detention Complex for arraignment on baseless disorderly conduct charges filed upon the false allegations of PO Cain. Cain falsely claimed that plaintiffs had been punching each other and three other individuals on the sidewalk. This prosecution was initiated for the purpose of covering up the officers' unlawful arrest of plaintiffs.
