The Defendant officers, angered by his questioning, Tasered him twice and continued to use excessive force, including punching him while he was handcuffed. At no time relevant herein did Plaintiff threaten or pose a threat to the defendants’ safety, and the defendants did not have any legal basis to subject Plaintiff to the use of force and/ or shoot him with a taser. \n\nAfter being transported to the 73rd Precinct, the plaintiff was further assaulted, had his clothes forcibly removed, and was punched repeatedly while restrained. The barbs from the taser remained lodged in Plaintiff's skin when he was\ntransported to the precinct. Upon arriving to the precinct, Plaintiff complied with the officers’ unlawful order for plaintiff to remove his clothing, but as plaintiff was removing his clothes, one of the defendant officers tackled Plaintiff to the ground, and began ripping Plaintiff’s clothes off, without any cause or legal justification to act in that manner. Then a defendant officer helped Plaintiff up off the ground but became angry with Plaintiff when plaintiff asked for an attorney, and the defendant officer punched plaintiff 6 times in the face and the other defendant officers joined him. The Plaintiff was taken to the hospital for treatment of his injuries, including chest tenderness, head and neck trauma, and was later unlawfully fingerprinted and photographed at the precinct. \n\nThereafter, Plaintiff was transported to Kings County Central Booking whereat the unlawful detention continued until Plaintiff was arraigned on August 28, 2021. He was falsely charged with multiple crimes including but not limited to Resisting Arrest, Obstructing Governmental Administration, Dazzling Headlights, and Reckless Driving without probable cause.  The charges were eventually dismissed, and the plaintiff claims to have suffered significant physical, emotional, and psychological harm due to the officers' unlawful actions. Plaintiff was required to appear in criminal court on two more occasions before all charges were dismissed and sealed in their entirety on December 7, 2021, after the Court granted plaintiff’s motion to dismiss the charges. The criminal prosecution terminated in plaintiff’s favor.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=jPF/piXBpDEHS8PlKWd7sQ==","type":"complaint"}]},{"name":"Rodriguez, Thomas vs City of Ny, et al.","start_date":"2023-11-09","payout_amount":0,"disposition":"","docket":"531585/2023","court":"Supreme Court - Kings","summary":"On March 4, 2023, Mr. Thomas Rodriguez (plaintiff) was assaulted and battered by Police Officer Antonio Dinuzzo and John Does (defendants) by punching the plaintiff in the face and repeatedly punching, beating, striking and pounding his body. The plaintiff was then immediately handcuffed without reading his Miranda rights and informing him of the reason of his arrest. None of the police officers arriving at the scene provided any help or assistance to the plaintiff. The defendants removed the plaintiff from the scene in handcuffs and brought him to the 73rd Precinct, and the plaintiff was imprisoned, confined and detained in a jail cell. Due to the plaintiff’s injury, the plaintiff was taken to Interfaith Medical Center, and while being seen and treated, the defendants falsely advised the hospital/medical personnel that the plaintiff had sustained injuries by resisting an arrest. He was later then taken back to the precinct, and then to the central booking thereafter. It was when the plaintiff appeared before the criminal court that he was being charged having committed acts of domestic violence against his fiancé, Anne Malii, and further injurious activity to Anne Malii's infant son. It was also then that he was informed of a temporary Restraining order/order of protection that specifically forbade him from having contact with fiancé, and her said infant son. The TRO was issued despite his fiancé having previously informed the defendants that no dispute between her and plaintiff existed, at the time of the plaintiff’s arrest; and that the TRO was issued without the knowledge of the plaintiff’s fiancé.
