Defendant Officer Roman Navarro told Plaintiff and his friends to leave the area or else they would arrest them, to which Plaintiff replied that they were legally standing there. Navarro and another officer entered the bodega to ask whether the group was bothering the owner, and the owner replied that he recognized the group and that they were not. Navarro and the other officer came back outside and told the group that if they didn't leave in ten minutes, they would all be arrested. The group decided to leave and travelled to Plaintiff's apartment. After 30 minutes, Plaintiff and his friends heard banging on the door of his apartment, and the peephole was blocked from the outside. Plaintiff opened the door, and ten police officers in SWAT gear entered, pointing tasers. The officers grabbed Plaintiff and his friends, forcing them outside.
