The man confronted the plaintiff and Plaintiff Bensabeur apologized.  As Bensabeur tried to leave, the man grabbed the Plaintiff and punched him in the back of the head; two other men joined in the assault and also began to attack Bensabeur.  Witnesses at the bar repeatedly told NYPD officers that Bensabeur had been assaulted and that the assailants ran away.  However, NYPD Officers Amet Vrzivoli and Aaliyah Card, as well as 8 Unidentified Officers arrested the Plaintiff and charged him with disorderly conduct and resisting arrest. Although Mr. Bensabeur did not resist arrest, he was assaulted by the Defendants during his arrest: the Defendant Officers hit Plaintiff multiple times, slammed him to the ground, put a knee in his back, loosened one tooth and knocked out one tooth.  On the day of his arrest, Mr. Bensabeur was taken to the hospital for the oral trauma and had a tooth extracted and received sixteen stiches inside his mouth and lip. Plaintiff Bensabeur was ROR'd at his arraignment, but was incarcerated for 19 hours.  He had to make 5 court appearances, missed work, and had to get dentures and implants.
