(Plaintiff had been unlawfully arrested by Detective Ehrlein on November 8, 2011; Detective Ehrlein had been disciplined for abusing his authority in this incident and was seeking to retaliate.) One of the officers asked if they could search Plaintiff’s person; he did not consent. Nevertheless, the officers aggressively pushed Plaintiff on the side of a police van and unlawfully searched him. They did not recover any illegal weapons, drugs, or contraband of any kind from Plaintiff’s person. The officers handcuffed Plaintiff, arrested him, and placed him in the back of the van as they drove around for approximately 4 hours and arrested several other people. They offered Plaintiff a water bottle, but Plaintiff noticed they had removed it from a public trash can before giving it to him. Plaintiff was taken to the 75th Precinct, where he was detained for many hours, and eventually to Kings County Central Booking. After being detained for approximately 24 hours, Plaintiff was arraigned, charged with several crimes, and released on his own recognizance. Defendants laid plaintiff face down on the floor of the van and applied extreme pressure to his legs for 30 seconds, causing severe pain. Plaintiff was transported to the 73rd precinct. After several hours, plaintiff was issued a DAT ticket, and was released from custody.
