There was no urgent need to arrest Plaintiff. Despite being visibly pregnant, Defendant officers transported her through multiple precincts without providing medical care, knowing she was in labor. At 9th Precinct she was taken by Defendant Detective Michael Franco to Manhattan Criminal Court. She was arraigned at Manhattan Criminal Court and released with no bail set. The charges on which she was arrested were ultimately dismissed. After Plaintiff was arraigned, Defendant Franco informed her for that she was the subject of another I-card for non-emergency allegations submitted more than a year ago by an officer of 75th Precinct in Brooklyn. He arrested her and transported her against her will back to 9th Precinct, where she was detained until officered from 75th Precinct arrived to take her into their custody. At the 75th Precinct's holding cell, Plaintiff experienced contractions. She notified Defendant Officers E and Garcia that she was in labor, and although she was visibly pregnant and in labor, the officers denied her medical attention for hours while celebrating a holiday party. When transferred to Kings County Hospital, she was handcuffed to the ambulance gurney by Defendant Officer Mcaleese. She was continued to be handcuffed during labor process. The handcuffs were removed when Plaintiff had to be administered with epidural. After giving birth, she was handcuffed and shackled again to the bed by Defendant Officer Richards, preventing her from properly caring for her newborn. Defendant Officer Richards also threatened that the ACS to take the newborn into their custody. Plaintiff struggled to feed her newborn with one arm and to move safely.
