Shannon Brooks, Det. Jorge Tobon, Det. Angus Mackenze, and PO Winston Favis forcibly entered Plaintiff's residence by breaking down the door with a battering ram. POs had no warrant to search or arrest, or other legal justification. Plaintiff and other occupants were falsely arrested. POs' stated reason for breaking into the apartment was the smell of marijuana smoke in the hallway. After arrest of the occupants, PO Ivan Rodriguez applied for a search warrant without noting that he had already gained entry to the residence and that the occupants had already been arrested. On or about November 8, 2012 Plaintiff was convicted and sentenced to prison. On August 21, 2014 the appellate court directed a suppression hearing, and on January 13, 2015 the presiding court granted suppression of all evidence seized and used to convict Plaintiff. On or about March 5, 2015 Plaintiff's conviction was vacated by the appellate court. Plaintiff suffered mental anguish and injuries as a result of this incident.
