Plaintiff attempted to stop the fight but did not strike or touch the customer. After police arrived at the scene, defendant police officers demanded security footage from plaintiff. Plaintiff claimed that only the store owner has access to the footage, but the owner was not present at the time. The officers threatened to arrest plaintiff if he did not produce the tape in that instant, and the intoxicated customer also falsely identified plaintiff as the person whom he had a fight with. Plaintiff was then arrested with tight handcuffs, despite witnesses at the scene telling the police that plaintiff was not the cashier in the fight. Plaintiff was then taken to the 42nd precinct, where he was strip-searched and detained. When the security footage was later presented to the officers, they refused to view it. The DA's office later refused to charge plaintiff with any crimes.
