Rachel Cresswell and other unknown NYPD officers, without cause or a warrant, approached Plaintiff with their loaded firearms outstretched and other objects. The officers grabbed, handcuffed and seized Plaintiff in an excessive manner, causing Plaintiff pain and suffering. The officers also used other objects to strike and restrain Plaintiff. Sgt. Cresswell arrested Plaintiff, and an unknown officer placed Plaintiff in handcuffs so tight that the Plaintiff's wrists turned red. Plaintiff was taken to a police station where he was held in custody for approximately 24 hours until he was released. The officers provided false and/or incomplete information to the DA's office, claiming that the Plaintiff made sexual contact with a civilian in Times Square when Plaintiff did not do so. They asked for voluntary dollar donations to support their music, as well. After a group of women took a CD and donated $10, police approached Sowe and asked him for identification; he complied, and was put in handcuffs for panhandling. The rest of the plaintiffs were each then pushed or thrown against a way, handcuffed, and brought to the Midtown South police precinct for panhandling. They remained there for 12 hours before being transported to central booking the next day. At that point, they learned they were being charged with robbery in the third degree, even though they had not committed a theft, much less used force in the commission of a theft. Police Officer TK Creswell, however, stated that she had observed the aforementioned women get robbed. The plaintiffs all went into custody at Rikers Island for seven days before charged were dismissed on May 9.  On November 8, 2014, Raphique Morris gave a CD to a tourist on 44th Street and Seventh avenue. After, the tourist gave Morris $15 as a voluntary donation. Morris was then arrested and charged with robbery in the third degree. Police officers stated that Morris had followed and placed hands on the tourists. The charged were dropped June 11, 2015. On August 31, 2013, Ove Williams received a voluntary donation from a passerby on the corner of Prince Street and Broadway. He was charged with third degree robbery. Police officer falsely stated that Williams had followed and placed hands on the passerby.
