When Plaintiff pulled up in front of his home, defendants, NYPD officers approached his car with their guns drawn. Plaintiff scared honked his car to alert his family. Plaintiff's father exited the house and then Plaintiff opened the car door and when he did the NYPD officers John and Jane Does, Dustin Diaz and Mark Whirl dragged him out of his car and physically assaulted him, causing injuries to his body and face and then arrested him. Plaintiff was also tasered and struck. Defendants hit plaintiff's head, pounded his head and body into the street. Plaintiff was also wrongfully arrested. The criminal charges were dismissed on August 12, 2024. Two defendants, NYPD officers Dustin Diaz and Mark Whirl gave conflicting accounts of what led to their decision to arrest the plaintiff, and based on this NYPD officers maliciously prosecuted the Plaintiff. There were also video recordings of the incident, and these videos undermined Defendants' account.
