POs responded by ordering him to \"get down\" but Plaintiff could not lie down due to the numerous pedestrians and instead sat on a stoop waiting for POs to approach. \n\nWhen POs approached they inexplicably grabbed Plaintiff from the stoop and threw him hard to the ground, causing injury to Plaintiff's elbow. Plaintiff was also tased and maced before he felt an officer kick him and was violently handcuffed. The single set of cuffs was too short for Plaintiff's size and caused excessive stress and strain on Plaintiff's joints. Plaintiff was brought to his feet and POs purportedly found a pill on Plaintiff's person. This pill was not Plaintiff's and it is believed the POs planted this pill to fabricate cause. Plaintiff was taken to the 6th Precinct, Bellevue hospital for treatment of his injuries, then Central Booking where he remained until approximately 3:30 p.m. when he was arraigned for disorderly conduct, resisting arrest, and possession of a controlled substance. The controlled substance charge was dismissed on November 17, 2014 after it was found that the pill was not an illegal substance. Plaintiff was forced to return to court 6 additional times until the remaining charges were dismissed on October 28, 2015.
