Returning from a weekend pass and sitting in the passenger seat of Rosa's vehicle at the intersection of York and Bridge Streets, defendants approached the vehicle and ordered Rosa and Plaintiff out. They were stopped because they were in a \"high narcotics crime area\". Defendants unlawfully searched Rosa and plaintiff, and recovered a small bag containing crack cocaine from Rosa's pocket. Brinadze lied to the Brooklyn DA about facts surrounding the arrest and swore out a perjured criminal complaint charging plaintiff with Criminal Possession of a Controlled Substance in the Seventh Degree. Brinadze alleged he recovered the drugs from the \"ground were [he] observed defendant drop it\". On February 28, 2013, charges against plaintiff were dismissed by the criminal court. Rosa consented to an Adjournment in Contemplation of Dismissal. Due to the arrest he failed to return to the Halfway House, and on December 2, 2012 was placed on escape status. After being released from Central Booking, plaintiff returned to the Halfway House on December 3, 2012. Due to his failure to meet curfew plaintiff was returned to FCI Cumberland on February 25, 2013, and held until September 25, 2013. Released from Cumberland, plaintiff was detained by NYS Dept of Correction and Community Supervision due to the arrest by Defendants. After plaintiff expressed that he did not have identification with him, defendant officers proceeded to search the plaintiff without probable cause or consent. After searching plaintiff and recovering nothing, one of the officers exclaimed “I got it” and hit plaintiff on the back of the head with his radio with tremendous force, causing the plaintiff to bleed excessively. Defendant officers, including Brinadze, continued to beat the plaintiff before placing him under arrest, despite no probable cause. Defendant Brinadze falsely informed the Kinds Country DA’s office that he observed plaintiff commit criminal possession of a controlled substance, attempted tampering with physical evidence, resisting arrest, and disorderly conduct, in an effort to cover up defendant officer’s unlawful arrest and use of excessive force on plaintiff.
