Plaintiff was a tenured guidance counsellor with the DOE on bed rest medical leave during her seventh month of pregnancy with twins.  Plaintiff went to her lawn to mediate the dispute with a neighbor, Defendant Ernst Jabouin, about leaves being blown across the street.  Plaintiff was holding the potato peeler she had been using, but Defendant Jabouin accused her of having a knife.   Because of the threats Plaintiff went in and called 911.\n\nFive NYPD vehicles arrived shortly thereafter.  The officers interviewed Defendant Jabouin first, then refused to speak to the gardeners.  When questioned whether she owned a knife Plaintiff conceded there were knives in her kitchen but that she held a potato peeler earlier. Because Plaintiff was in a t-shirt and sweats, she received permission to get a jacket, but Defendant Officers Edwanna Johnson, Chera Voels and Christina Meehan illegally entered the house and informed her that their supervisor had ordered them to arrest Plaintiff.  When Plaintiff indicated the potato peeler was in a kitchen drawer, Defendant Voels illegally searched the kitchen and returned with a different knife.  When told that she would be handcuffed, Plaintiff asked that she be cuffed in front due to the high risk pregnancy, offered to show the medical records, but the Defendant Officers refused and cuffed Plaintiff behind her back, causing physical pain and extreme emotional distress.  Defendants denied her a moment to put on underwear.  Defendant Officer John Froehlich also refused to cuff Plaintiff on the front.   When Plaintiff pointed out that her home was being left open, Defendant Voels went in to get keys and lock it, but also illegally opened Plaintiff’s wallet and took her ID.\n\nPlaintiff was taken to the 105th Precinct.  Two officers cut the drawstring to her sweatpants, causing them to fall to the floor and exposing Plaintiff.  Plaintiff was forced to stand for more than 30 minutes, despite her highly visibly condition.  Plaintiff received a desk ticket for menacing and harassment, which caused the DOE to suspend her pending resolution of the charges.
