Plaintiff told the officers to leave and shut the door on them once they had left. The two officers forced the door back open, pushed Plaintiff to the ground, and began violently striking him about the body. Plaintiff was dragged out of the apartment and slammed on the hallway floor, where he was forcefully pinned to the ground by his head. Additional NYPD officers came in. The officers handcuffed him and ignored his complaints that the handcuffs were too tight. At no point did Plaintiff resist arrest. The officers then mocked plaintiff's gender identity and took him to a precinct. P.O.s Alvarz and Brennan made false statements to the DA's office that plaintiff had resisted arrest, and as a result plaintiff was charged with resisting arrest and harassment in the second degree.
